Drug possession is a serious offense, and if you or a loved one are caught with a controlled substance, you are likely wondering, “What’s next?” Texas is known for being tough on crime and doling out severe punishments for those in violation of the law. You need an insightful criminal defense attorney on your side who has an intimate knowledge of the court system. As a former prosecutor, I understand the inner workings of the courts and will use that information to defend my clients passionately.
I understand the harsh criticism you face from the community and the embarrassment attached to a felony drug charge. I also know how a conviction can limit your job and education opportunities. I am not here to judge you, only to represent you. You can feel comfortable discussing the details of your case with me, as the more facts I have, the stronger my defense strategy.
While you may have been caught selling, distributing, or manufacturing drugs in Texas, federal charges may be leveraged against you. If the crime took place on federal land, involved federal employees, or crossed state lines, the federal government has the right to prosecute you.
Manufacturing penalties and convictions depend on the type of drug manufacturing, the amount cultivated, the amount created when the police discovered it, and the defendant’s past convictions. Prosecutors must produce sufficient evidence to prove intent to distribute or deliver when charging an individual with this crime.
There are two types of possession charges in Texas. The first is simple possession – when you have the substance for personal use. The second is possession with the intent to distribute and carries a much harsher penalty than the first. If you are caught selling drugs in Texas, you can face felony possession with intent to deliver. If you are in Frisco, Texas, or one of the neighboring areas of Plano, Allen, Collin County, and Denton County, I am ready to help.
The United States Drug Enforcement Agency (DEA) breaks drugs, substances, and specific chemicals used to manufacture drugs into five categories. The category or schedule a drug belongs to is based on the substance’s accepted medical use and the potential for the substance’s abuse or dependency.
Schedule I drugs are deemed the most dangerous due to their high potential for abuse and for individuals to become severely psychologically or physically dependent. These drugs have no accepted medical use and include heroin, marijuana, peyote, ecstasy, and more.
Drugs such as cocaine, Vicodin, fentanyl, and others are classified as Schedule II drugs. These are also considered dangerous and carry a high potential for abuse and dependence. Schedule II drugs have a moderate to low potential for dependence and abuse. Testosterone, ketamine, and anabolic steroids are in that category.
Schedule IV drugs have a low potential for abuse and dependence, including Xanax, Valium, and Ambien. The drugs in Schedule V have a lower potential for abuse and dependence than Schedule IV substances. These are substances like Lyrica, Robitussin, and Lomotil.
Texas uses these schedules to determine the severity of drug possession penalties. Four penalty groups were created based on these classifications, each with a distinct set of penalties. Marijuana is in a category of its own.
Incarceration and fines are among some of the penalties you will face if convicted of a felony drug charge. You also stand to have your voting and gun rights stripped or restricted. However, there are circumstances where these rights can be legally restored.
I know the law and the instances in which exceptions or violation reductions can be introduced. I have worked as a prosecutor and represented clients in hundreds of felony and misdemeanor trials. I know how to connect with a jury or negotiate a practical plea bargain on your behalf. My law office is ready to assist you if you are in Frisco, Texas, and surrounding areas of Plano, Allen, Collin County, and Denton County, so call today.
